
17th January 2025 – (Hong Kong) The Immigration Department (ImmD) of Hong Kong has executed a series of territory-wide operations aimed at combatting illegal employment, known as “Twilight,” alongside joint initiatives with the Hong Kong Police Force, dubbed “Champion” and “Windsand.” These operations took place over four consecutive days from 13th January to 16th January, resulting in the arrest of eight suspected illegal workers, one suspected employer, and two overstayers.
During the “Twilight” operations, ImmD Task Force officers targeted five locations, including renovation sites and restaurants, leading to the arrest of two men, both aged 37, suspected of being illegal workers.
Operation “Champion” was more extensive, involving raids at 54 locations across Eastern and Western districts. This operation yielded six further arrests of suspected illegal workers, comprised of three men and three women aged between 28 and 59. Additionally, a 53-year-old woman was detained on suspicion of employing one of the illegal workers. Two overstayers, aged 42 and 44, were also apprehended, with one suspected of possessing a forged Hong Kong identity card.
An ImmD spokesperson reiterated the legal consequences for those violating immigration laws. Individuals contravening conditions of stay could face fines of up to $50,000 and a maximum of two years’ imprisonment. Furthermore, illegal immigrants and overstayers are explicitly prohibited from employment without the Director of Immigration’s consent, facing similar penalties.
The spokesperson emphasised that employing individuals not lawfully entitled to work is a serious offence, with penalties significantly increased under the Immigration Ordinance. Employers could now face fines of up to $500,000 and ten years’ imprisonment for such violations, reflecting the severity of the issue. The High Court has stated that those found employing illegal workers should expect immediate custodial sentences.
Employers are compelled to take all reasonable steps to confirm the lawful employability of potential employees, including verifying identity cards and travel documents. Failure to conduct these checks will not constitute a defence in legal proceedings. The ImmD has pledged to maintain rigorous enforcement efforts to tackle illegal employment in the territory.
