17th January 2025 – (Hong Kong) A 70-year-old man, identified as LKH, was pronounced guilty of indecent assault on his 5-year-old granddaughter, X at the West Kowloon Magistrates’ Courts. The incident, which took place back in 2023 on 3rd May, involved the man touching the child inappropriately while they were eating fruits together at their residence.
During the trial, the prosecution presented video evidence of X’s testimony where she detailed the assault. She described how her grandfather used his fingers to touch her private area while they were seated on the floor mats enjoying their snacks. X mentioned feeling uncomfortable and distressed by the incident, prompting her to disclose the event to her mother, who subsequently reported it to the authorities.
Despite the accused denying the allegations of misconduct, the judge ruled in favour of the child’s testimony, highlighting the clarity and consistency in X’s account. The court acknowledged X’s unwavering stance during cross-examination, where she reaffirmed the instances of the assault, emphasising that at times the man touched her beneath her clothing directly.
Furthermore, the judge noted discrepancies in the man’s defence, where he claimed that he only touched X in response to her purportedly interfering with his breathing apparatus. However, the court found these explanations to be inconsistent with the evidence presented, ultimately concluding that the man’s actions were deliberate and amounted to indecent assault.
The sentencing has been adjourned until 14th February, pending a thorough assessment of the man’s background and psychological profile. In the interim, he will remain in custody under supervision.
