Former SFC Associate Director charged with conspiracy to obstruct justice

9th January 2025 – (Hong Kong) The Independent Commission Against Corruption (ICAC) has charged a former Associate Director of the Securities and Futures Commission (SFC) with conspiracy to pervert the course of public justice. The charge arises from allegations that she advised individuals under investigation for suspected market manipulation related to a listed company on how to navigate the inquiry, including suggestions to destroy potential evidence.

Deng Yingxia, 48, who previously served in the Market Misconduct Team within the SFC’s Enforcement Division, faces one count of conspiracy to pervert justice, contravening both Common Law and section 159A of the Crimes Ordinance. She has been released on ICAC bail and is scheduled to appear at the Eastern Magistrates’ Courts on January 10 for a preliminary hearing.

The ICAC’s investigation commenced following a corruption complaint, leading to Deng’s arrest during a joint operation with the SFC in April 2024. At the time of the alleged offences, the SFC was conducting an investigation into suspected false trading and market manipulation involving China Gas Industry Investment Holdings Company Limited.

Deng had access to confidential information regarding this investigation, despite not being actively involved in the investigative process. It is alleged that between 15th and 27th July July, 2022, she conspired with a subject of the investigation to obstruct justice. This included meetings with the individual and others involved, where she purportedly offered advice on how to respond to potential questions from the SFC and suggested measures to undermine the investigation, such as destroying evidence.

The SFC has provided full cooperation to the ICAC throughout this investigation. The ICAC emphasises its commitment to maintaining the integrity of Hong Kong’s financial markets and has a zero-tolerance policy towards any actions that compromise fair market practices. The commission pledges to take decisive action against corruption and misconduct involving public officers to uphold justice.
