South Korean court to review arrest of impeached President Yoon Suk-yeol

16th January 2025 – (Seoul) A South Korean court will commence proceedings on Thursday to assess a legal application submitted by President Yoon Suk-yeol’s defence team, challenging the appropriateness of his arrest on Wednesday. This review, known as an arrest appropriateness procedure, allows a suspect to contest the legality of their detention and seek release from custody.

According to local broadcaster YTN, the Seoul Central District Court is set to initiate the process at 5pm local time. Yoon’s legal representatives filed the application shortly after his arrest, contending that the Corruption Investigation Office for High-ranking Officials (CIO) lacks the jurisdiction to investigate insurrection allegations. They further argue that the arrest warrant should have originated from the Seoul Central District Court instead of the Seoul Western District Court.

Under South Korean law, the court is obliged to address the application within 48 hours of receipt and must determine whether to grant release within 24 hours following the conclusion of its review.

On Wednesday, investigators confirmed the execution of the arrest warrant for Yoon, who has been impeached, and he was subsequently transferred to the CIO for questioning regarding the allegations against him. The unfolding legal proceedings are emblematic of the heightened political tensions surrounding Yoon’s presidency and the ongoing scrutiny of corruption within the country’s leadership.
